In October of 2019, the NCAA’s top governing board voted unanimously to create a framework permitting student-athletes the opportunity to benefit from the use of their name, image and likeness in a manner consistent with the collegiate model. The NCAA plans to gather feedback through April 2020 to refine its recommendations on the principles and regulatory framework. The NCAA board has requested that Divisions I, II, and III create rules by January 2021.  Therefore, meaningful change as to how college athletes can be compensated will likely take a couple of years.  Once the legal framework is set in place, McInteer & O’Rear PLC will assist clients, students, and their families in negotiating:

  • Trademark Rights & Registrations (including logo rights and name rights)

  • Publicity Rights (including video games, merch, shoes)

  • Right to Work (including using name to operate sports clinics)

  • Copyright (books, music, films, and biographies)
